ICC CRICKET WORLD CUP 2019 – CARDIFF FLAG TEAM COMPETITION

TERMS AND CONDITIONS

Competition Overview

1.             International Cricket Council FZ LLC ("ICC”) a Dubai registered company with its registered office at Executive Desk 13D, Second Floor, Building 2, Dubai Media City, United Arab Emirates, is operating a competition in collaboration with Cardiff Council (the “Competition”) to win the chance to be a member of the “Flag Team” at the Cardiff Wales Stadium during the ICC Cricket World Cup 2019 (the “Tournament”).

2.             Entrants are deemed to have accepted, and agree to be bound by, these terms and conditions and the terms and conditions of Cardiff Council upon entry into the Competition. Entrants are also deemed to have read, understood and accepted the Flag Team FAQs. To the extent there is any conflict between these terms and conditions and the terms and conditions of Cardiff Council, these terms and conditions shall prevail.  

3.             The decision of ICC regarding any aspect of the Competition is final and binding (including as to the award of the Prize), and the ICC shall not enter into any correspondence regarding the Competition.

Entry Process

4.             The Competition is open to all UK residents aged between 16 and 23 (inclusive) and will be open for entry between 9.00am (UK time) on 22/1 2019 and close at 11.59pm (UK time) on Tuesday 5 February 2019. Entries received after this time will not be valid and will not be included in the Competition prize draw.

5.             Employees of the ICC, England and Wales Cricket Board Limited (“ECB”), Cardiff Council and their immediate families and any individual directly or indirectly associated with the operation of the Competition shall not be eligible to enter the Competition.

6.             In entering the Competition, each Entrant confirms that they are eligible to do so and eligible to claim the Prize. The ICC may require an Entrant to provide proof that they are eligible to enter the Competition (including proof of age).

7.             To enter the Competition, Entrants must “like” the official Cardiff Council Facebook page, “like” the relevant Facebook post promoting the Competition and correctly answer the question contained therein by commenting on that post (“Entry”). Entries will not be accepted by any other means.

8.             The Competition is free to enter and no purchase is necessary. Only one entry per Entrant is permitted. 

9.             The ICC accepts no responsibility for Competition entries that are not successfully completed, regardless of cause, including (without limitation) due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure, of any kind.

Prize

10.          Cardiff Council and the ICC will select up to ten winners of the Competition at random, each of which shall be sent an information pack containing details of the Flag Team programme (“Flag Team Terms”), including the accreditation process and a requirement for all members of the Flag Team to commit to attending two training days prior to the Tournament and a minimum of three matchdays during the Tournament. You acknowledge and agree that all members of the Flag Team must comply with the ICC’s reasonable instructions at all times in respect of their participation in the Flag Team programme.

11.          Each winning entrant must confirm that they are able to accept the Prize and the Flag Team Terms within 48 hours of being contacted by the ICC or Cardiff Council. In the event that any winning Entrant fails to confirm their acceptance of the Prize and/or the Flag Team Terms by this date (or the ICC otherwise determines that the relevant winner has breached these terms and conditions), the ICC reserves the right to offer the Prize to another Entrant.

12.          The Prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered.

Limitation of Liability

13.          Neither the ICC, ECB or Cricket World Cup 2019 Limited, nor any of their affiliates, agents, employees, officers, directors or representatives will be liable (to the extent permitted by law) for any direct, indirect or consequential loss or damage arising out of the organising or holding of the Competition or as a result of any Entrant’s participation in the Competition or as a result of the winning, collecting, use or enjoyment of any Prize, or if the Competition does not run as planned. Competition Entrants’ statutory rights are not affected.

14.          The ICC reserves the right to otherwise cancel the Competition or to amend these terms and conditions or the Prize at any time without notice and no liability shall attach to the ICC (or the ECB) as a result thereof.

Entrants’ Personal Data

15.          The ICC, ECB and their affiliates will use the data you provide in response to the Competition (“Your Information”) for the purposes of operating the Competition. Your Information will be used solely in accordance with current data protection legislation and will only be processed in accordance with the ICC Cricket World Cup Privacy Policy here and these terms and conditions. This may include sharing such personal data with third party suppliers solely for the purpose of those third parties delivering the Prize or otherwise in connection with the operation of the Competition.

 

16.          The winning Entrants may be asked to take part in certain promotional activities of the ICC relating to the Competition. By entering the competition, each Entrant irrevocably and unconditionally consents without compensation to the recording of their voice, image and likeness during the time they spend as part of the Flag Team (the “Recordings”) and winning Entrants further consent, on an irrevocable, worldwide and perpetual basis, to the ICC and the ECB using, disclosing, reproducing, transmitting, exhibiting, communicating, renting, adapting or publishing anywhere in the world the Recordings in whatever form the ICC and/or ECB deem fit.

General

17.          If any of these terms are determined to be illegal, invalid or otherwise unenforceable then Entrants agree that the remaining terms shall continue in full force and effect.

18.          The ICC reserves the right to refuse entry to the Competition, or refuse to award the Prize to anyone in breach of these terms and conditions or to anyone, who in ICC’s sole opinion, has otherwise acted improperly or dishonestly.

19.          These terms and conditions will be governed by and construed in accordance with the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

Trosolwg ar y Gystadleuaeth

20.          Mae International Cricket Council FZ LLC ("ICC”), cwmni cofrestredig yn Dubai y mae ei swyddfeydd cofrestredig yn Nesg Weithredol 13D, Ail Lawr, Adeilad 2, Dubai Media City, yr Emeraethau Arabaidd Unedig, yn cynnal cystadleuaeth mewn cydweithrediad â Chyngor Caerdydd (y “Gystadleuaeth”) i ennill cyfle i fod yn aelod o “Dîm y Faner” yn Stadiwm Caerdydd Cymru yn ystod Cwpan Criced y Byd ICC 2019 (y “Twrnamaint”).

21.          Wrth gymryd rhan yn y Gystadleuaeth, ystyrir bod yr ymgeiswyr wedi derbyn y telerau ac amodau hyn ac yn cytuno i fod yn rhwym wrthynt, ac felly hefyd delerau ac amodau Cyngor Caerdydd.Ystyrir hefyd fod ymgeiswyr wedi darllen, deall a derbyn Cwestiynau Cyffredin Tîm y Faner.Pan fo gwrthdaro rhwng y telerau ac amodau hyn a thelerau ac amodau Cyngor Caerdydd, y rhain fydd yn trechu.  

22.          Bydd penderfyniad yr ICC yn derfynol ac yn rhwymol (gan gynnwys penderfynu dyfarnu’r Wobr), ac ni oheba’r ICC ag unrhyw un ynghylch y Gystadleuaeth.

Proses Gystadlu

23.          Mae’r Gystadleuaeth yn agored i bob preswylydd yn y DU rhwng 16 a 23 oed (yn cynnwys y rhain); bydd yn agor am 9.00am (GMT) ar 22/1 2019 ac yn cau am 11.59pm (GMT) ddydd Mawrth 5 Chwefror 2019. Ni fydd ceisiadau a ddaw i law wedi hyn yn ddilys ac ni chânt eu cynnwys yn y Gystadleuaeth.

24.          Ni fydd cyflogeion yr ICC, Bwrdd Criced Cyfyngedig Cymru a Lloegr (“ECB"), Cyngor Caerdydd na’u teulu agos nac unrhyw unigolyn sy’n gysylltiedig yn uniongyrchol neu anuniongyrchol â gweithrediad y Gystadleuaeth yn gymwys i ymgeisio.

25.          Wrth gystadlu, bydd pob Ymgeisydd yn cadarnhau ei fod yn gymwys i wneud hynny ac yn gymwys i hawlio’r Wobr.Mae’n bosibl i’r ICC ofyn i Ymgeisydd gyflwyno tystiolaeth ei fod yn gymwys i gystadlu (gan gynnwys tystiolaeth o oedran).

26.          I ymgeisio, bydd yn rhaid i Ymgeiswyr “hoffi” tudalen Facebook swyddogol Cyngor Caerdydd, “hoffi’r” post Facebook perthnasol sy’n hyrwyddo’r Gystadleuaeth ac ateb y cwestiwn yn y post hwnnw’n gywir yn yr adran sylwadau (“Ymgeisio”).Ni dderbynnir ceisiadau trwy unrhyw ddull arall.

27.          Mae’r gystadleuaeth am ddim ac nid oes yn rhaid prynu unrhyw beth.Unwaith y caiff pob Ymgeisydd ymgeisio.  

28.          Nid yw’r ICC yn cytuno bod ganddo unrhyw gyfrifoldeb dros geisiadau nas cwblheir yn llwyddiannus waeth beth yw’r rheswm dros hynny, yn cynnwys (heb gyfyngiad) diffyg technolegol, camweithrediad technegol, methiant caledwedd neu feddalwedd cyfrifiadurol, methiant lloeren, rhwydwaith neu weinyddwr o unrhyw fath.

Gwobr

29.          Bydd Cyngor Caerdydd a’r ICC yn dewis hyd at ddeng enillydd ar hap. Caiff pob un becyn gwybodaeth yn cynnwys manylion rhaglen Tîm y Faner (“Telerau Tîm y Faner”) yn cynnwys y broses achredu a gofyniad i bob aelod o Dîm y Faner ymrwymo i fynd i ddau ddiwrnod hyfforddi cyn y Twrnamaint ac o leiaf dri diwrnod gêm dros gyfnod y Twrnamaint.Rydych yn cydnabod ac yn cytuno bod yn rhaid i bob aelod o Dîm y Faner gydymffurfio â chyfarwyddiadau rhesymol yr ICC bob amser mewn perthynas â’u rhan yn rhaglen Tîm y Faner.

30.          Bydd yn rhaid i bob ymgeisydd llwyddiannus gadarnhau y gall dderbyn y Wobr a Thelerau Tîm y Faner o fewn 48 awr wedi i’r ICC neu Gyngor Caerdydd gysylltu. Os nad yw Ymgeisydd buddugol yn cadarnhau derbyn y Wobr a/neu Delerau Tîm y Faner erbyn y dyddiad hwn (neu os penderfyna’r ICC fod yr enillydd perthnasol wedi torri’r telerau ac amodau hyn), ceidw’r ICC yr hawl i gynnig y Wobr i Ymgeisydd arall.

31.          Ni ellir cyfnewid na throsglwyddo’r Wobr na chynnig arian parod yn ei lle.

Cyfyngiad y Cyfrifoldeb

32.          Ni fydd yr ICC, ECB na Cricket World Cup 2019 Limited, nac un rhyw un sy’n gysylltiedig, asiantau, cyflogeion, swyddogion, cyfarwyddwyr na chynrychiolwyr yn gyfrifol (yn unol â’r gyfraith) am golled neu ddifrod uniongyrchol, anuniongyrchol neu ganlyniadol yn sgil trefnu neu gynnal y Gystadleuaeth hon nac o ganlyniad i ran Ymgeisydd yn y Gystadleuaeth nac o ganlyniad i ennill, casglu, defnyddio neu fwynhau unrhyw Wobr, nac os nad aiff y Gystadleuaeth rhagddi yn ôl y cynllun.Ni effeithir ar hawliau statudol Ymgeiswyr y Gystadleuaeth.

33.          Ceidw’r ICC yr hawl i ganslo’r Gystadleuaeth neu addasu’r telerau ac amodau hyn neu’r Wobr ar unrhyw adeg heb roi rhybudd, ac ni fydd unrhyw gyfrifoldeb ar yr ICC (na’r ECB) o ganlyniad i hynny.

Data Personol Ymgeiswyr

34.          Bydd yr ICC, ECB a phobl gysylltiedig yn defnyddio’r data a rowch wrth ateb y Cwestiwn (“Eich Gwybodaeth”) at ddibenion cynnal y Gystadleuaeth.Defnyddir eich gwybodaeth yn unig yn unol â deddfwriaeth diogelu data gyfredol a’i phrosesu yn unig yn unol â Pholisi Preifatrwydd Cwpan Criced y Byd yr ICC a’r telerau ac amodau hyn.Gallai hyn gynnwys rhannu data personol â chyflenwyr trydydd parti yn unig at ddibenion y trydydd parti hwnnw wrth ddarparu’r Wobr neu fel arall mewn cysylltiad â chynnal y Gystadleuaeth.

 

35.          Mae’n bosibl y gofynnir i’r Ymgeiswyr buddugol gymryd rhan yng ngweithgareddau hyrwyddo’r ICC yn gysylltiedig â’r Gystadleuaeth.Wrth ymgeisio, bydd pob Ymgeisydd yn cydsynio yn ddiamod ac yn ddi-droi’n-ôl i recordio ei lais, llun a thebygrwydd heb dâl yn ystod y cyfnod y bydd yn rhan o Dîm y Faner (y “Recordiadau”) a bydd Ymgeiswyr buddugol yn cydsynio hefyd ar sail ddi-droi’n-ôl, ryngwladol a pharhaus i’r ICC a’r ECB ddefnyddio, datgelu, atgynhyrchu, darlledu, arddangos, cyfathrebu, rhentu, addasu neu gyhoeddi’r Recordiadau yn unrhyw le yn y byd a thrwy unrhyw ddull y creda’r ICC a/neu’r ECB sy’n addas.

Cyffredinol

36.          Os ceir bod unrhyw un o’r telerau hyn yn anghyfreithlon, annilys neu na ellid ei orfodi, cytuna’r Ymgeiswyr fod y gweddill yn parhau mewn grym llawn ac yn gwbl effeithiol.

37.          Ceidw’r ICC yr hawl i wrthod ymgais neu wrthod rhoi’r Wobr i unrhyw un sy’n torri’r telerau ac amodau hyn neu unrhyw un sydd, ym marn yr ICC yn unig, wedi ymddwyn yn amhriodol neu anonest mewn ffordd arall.

38.          Llywodraethir y telerau ac amodau hyn gan gyfraith Cymru a Lloegr ac fe’u lluniwyd yn unol â hi, ac mae’r partïon yn cytuno i ufuddhau i awdurdod Llysoedd Cymru a Lloegr yn unig.
